Terms of Use

These Terms govern your use of OutTheyGo (the “App”), a color escape puzzle game developed by Alessandro Pace (“we”, “our”, or “us”). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Using the App

OutTheyGo is provided for personal, non-commercial entertainment. You may use the App on Apple devices associated with your account, subject to Apple’s applicable App Store terms and usage rules. We may improve, change, suspend, or discontinue parts of the App over time.

2. Gameplay and virtual items

The App can include levels, scores, stars, streaks, hints, revives, and other virtual items. These features have no cash value, cannot be transferred outside the App, and may be adjusted when reasonably necessary to maintain or improve the game.

3. Purchases and subscriptions

Optional purchases, including OutTheyGo PRO if offered, are sold and processed by Apple. Prices, billing periods, renewal terms, cancellation, and refund eligibility are shown in the App Store purchase flow and governed by Apple’s terms. You can manage subscriptions and request eligible refunds through your Apple account. Restoring purchases requires the Apple ID used for the original transaction.

4. Game Center and fair play

If you use Game Center, you agree not to cheat, manipulate scores or achievements, interfere with leaderboards, or disrupt the App or related services. Apple’s Game Center terms also apply.

5. Intellectual property

The App, including its code, puzzle systems, generated and curated levels, artwork, audio, text, and design, is owned by or licensed to us and is protected by intellectual property laws. These Terms do not transfer ownership to you.

6. Acceptable use

You may not copy, sell, rent, distribute, modify, reverse-engineer, attempt to extract source code from, or create unauthorized derivative works of the App except where applicable law expressly permits it. You may not use the App unlawfully or attempt to harm its security, availability, or other players’ experience.

7. Feedback

If you send ideas, suggestions, or bug reports, you allow us to use that feedback without restriction or payment to improve the App. Do not send material you do not have the right to share.

8. Third-party services

The App can use services provided by Apple, Mixpanel, and RevenueCat. Those services are governed by their own terms and policies. We are not responsible for third-party services outside our reasonable control.

9. Disclaimers

The App is provided “as is” and “as available” to the fullest extent permitted by law. We do not promise that the App will always be uninterrupted, error-free, or compatible with every device or future operating-system version. Nothing in these Terms excludes rights that cannot legally be excluded.

10. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Where liability cannot be excluded, it is limited to the amount you paid for the App or related purchase during the 12 months before the claim, unless applicable law requires otherwise.

11. Changes to these Terms

We may update these Terms when the App, our business, or legal requirements change. The date at the top shows the latest revision. Continuing to use the App after updated Terms take effect means you accept them.

12. Governing law

These Terms are governed by the laws that apply in the place where we are established, without limiting any mandatory consumer rights available where you live.
